Affiliate program terms

1. Purpose

These terms (the "Affiliate Terms") govern participation in the QRTada affiliate program, run by EI QRTada, a French sole trader ("entrepreneur individuel"), SIRET 940 859 457 00019 ("QRTada", "we"). They bind QRTada and anyone who joins the program (the "Affiliate", "you"). You act independently: these Affiliate Terms create no employment, agency, partnership or joint venture.

2. Joining the program

You join in one click from the Affiliate program page in your QRTada account (a paid plan is not required). There is no application and no manual review: your affiliate account is active immediately, with your link and code. By joining, you accept these Affiliate Terms. You must be an adult, provide accurate information and handle any tax and social obligations related to the commissions you receive. We may suspend an affiliate account in case of breach (sections 7, 8 and 10).

3. Tools

As soon as you join, the Affiliate program page in your account gives you a dashboard (clicks, sign-ups, paying customers, pending, approved and paid commissions, payout requests), customizable links in the form qrtada.com/...?via={code}, a personal referral code and a link to the public brand kit (logos, icons, colors, banners). You may use the QRTada brand only to promote the Service and in line with the brand kit usage rules.

4. Tracking and attribution

• A sale is credited to you when the customer signs up within 60 days of their last click on your link (last-click attribution).
• Tracking relies on a server-side record of the followed link and, if the visitor accepts it, a 60-day first-party cookie (see the cookie policy). Attribution can also come from your referral code, entered by the customer when choosing a plan, even without clicking your link; an entered code counts as the last click. Attribution is locked from the first commission. You cannot use your own code.
• Each customer account can only be attributed once. In case of doubt, our records prevail unless proven otherwise.

5. Commissions

• Commissions are calculated on the amount actually collected, excluding taxes, net of refunds, credits and payment disputes. If a discount applies, the commission applies to the price actually paid.
• Commissions are calculated and paid in euros. For a payment collected in US dollars, the basis is converted to euros at the rate of the day of payment: the rate our payment provider (Stripe) actually applied when crediting euros or, if unavailable, the reference rate published by the European Central Bank that day. This rate is stored with the commission and reused for any later correction (refund, dispute).
• Optional customer discount: if you turn it on from your Affiliate program page, customers attributed to you (link or referral code) automatically get 20% off the first month of a monthly plan or 10% off the first year of a yearly plan at checkout. It applies to new payments, not to subscriptions already running, and is not granted while your affiliate account is frozen or suspended.
• A commission stays pending for 30 days after the payment is collected, to cover the 14-day legal withdrawal period for consumers. It is then approved, or voided if the payment was refunded or disputed.
• A commission already paid on a payment later refunded or disputed is deducted from future commissions.

6. Payouts

• You request your payout from the Affiliate program page in your account once your approved commissions reach €50. Below that, they stay yours and add up until the threshold.
• You enter the IBAN and account holder to credit. You can save them for future requests; they are encrypted on receipt and never shown in full again (only the last 4 characters are visible). You can delete them at any time.
• Only one request can be pending at a time. It covers all commissions approved at its date. We send the SEPA transfer in euros after a check, usually within a few business days, then mark the request as paid; you get an email.
• If your bank account is held in another currency (for example US dollars), your bank or provider converts the transfer: the rate and fees of that conversion are yours. Any fees charged by your own bank are also yours.
• We may decline or cancel a request (incorrect bank details, suspected fraud) and tell you why; the commissions concerned then stay approved and can be requested again, unless fraud is established.
• If you act as a business, you provide a compliant invoice or accept the self-billing we offer.

7. Prohibited practices

The following are prohibited and lead to cancellation of the related commissions and removal from the program:

• self-referral, including through a relative, another account or another entity you control;
• bidding on the "QRTada" brand and its variations in search engines and ad networks, and using domain names or social accounts containing the brand;
• fake reviews, spam (unsolicited emails, messages or comments), misleading advertising, false promises (for example calling the Service "free" without mentioning the subscription);
• cashback and coupon sites not approved by us in writing;
• cookie stuffing, hidden redirects, pop-ups or any technique that credits a sale without a real action by the visitor;
• any communication that harms QRTada's reputation or breaks the law.

You must follow advertising and endorsement rules, including the US FTC Endorsement Guides and EU and French rules on commercial influence: every promotional content must clearly disclose the commercial relationship (for example "affiliate link" or "sponsored by QRTada").

8. Fraud

If there are signs of fraud (same card, IP address or device for you and the customer, abnormal refund rate, artificial traffic), we may freeze commissions during the review (no payout request is possible meanwhile), then void them if fraud is established. You are informed and can provide your explanations.

9. Personal data

Each party is responsible for its own processing. You receive no personal data about customers; your dashboard shows aggregated data. Your data is processed according to the privacy policy.

10. Term, changes and termination

These Affiliate Terms apply from the moment you join, for an indefinite period. Either party may end participation at any time by email with 15 days' notice; we may end it without notice in case of breach. Approved, non-fraudulent commissions at the end date remain due: you request their payout as set out in section 6 or, below the €50 threshold, by email to bonjour@qrtada.com, and we pay them in euros within 60 days; no further commissions are due afterwards.

We may change these Affiliate Terms, including rates, with 30 days' notice by email. Changes do not affect commissions already earned.

11. Liability

Our liability to you is limited to the commissions owed. We do not guarantee any sales volume. You will hold QRTada harmless from any claim related to your own content and promotional practices.

12. Governing law

These Affiliate Terms are governed by French law. Failing an amicable settlement, any dispute falls under the jurisdiction of the courts for the place where the publisher has its business address, in France, subject to mandatory rules protecting non-professional affiliates.
